Swift EMS Solutions LLC – Mobile App

1. Introduction

Swift EMS Solutions LLC (“Swift EMS,” “Company”, “we,” “our,” or “us”) provides a mobile application (the “App”) that lets authorized users of our customer organizations (“Organizations”) view operational documents those Organizations host on the Swift EMS web platform (the “Service”). This Policy describes how we handle information in the App for users located in the United States. Swift EMS does not host, transmit, or process protected health information governed by HIPAA.

2. Our Role Under U.S. Privacy Laws

Swift EMS acts solely as a service provider (also called a processor) to each Organization. We process personal information only on that Organization’s instructions, do not sell or share personal information, and do not combine it with data from other sources except as necessary to operate the Service.

3. Information We Handle and Why

When you enter the one-time, six-character registration code supplied by your Organization, the App stores an opaque credential on your device that proves you may access specified documents. This credential and routine server-connection data (such as IP address, device type, and request timestamp) fall within the California Privacy Rights Act (CPRA) categories of Identifiers and Internet or other electronic network activity information.

For employees, the App also records which document pages you open and the time of each view. These audit events are returned to your Organization so it can meet training, regulatory, or operational requirements. The App does not record how long you viewed a page.

For guests, Swift EMS stores only the non-identifying credential needed to sync documents.

We intentionally avoid collecting names, email addresses, precise geolocation, payment data, contact lists, or advertising identifiers, and we do not embed third-party analytics or advertising code. Anonymized crash data is collected to ensure application performance. 

4. How We Use Information

Swift EMS uses the limited data above only to

  1. authenticate your device and keep your local document cache synchronized;
  2. deliver employee viewing logs to the controlling Organization; and
  3. maintain the security and reliability of our infrastructure and software.

We do not profile, enrich, or otherwise exploit the data for our own marketing.

5. Disclosure of Information

Viewing logs and related metadata reside in isolated customer accounts. Swift EMS personnel do not access an Organization’s audit trail except when required for security, support, or legal compliance, and then only under strict access controls. If we receive a valid legal demand for data, we will direct the requesting party to the relevant Organization unless prohibited by law.

6. Security

All traffic between the App and the Service is encrypted using TLS. Swift EMS applies industry-standard technical and organizational safeguards—including logical access controls, vulnerability management, and continuous monitoring—to protect customer data in our U.S. facilities. While no system is perfectly secure, we regularly review and improve our controls to reduce foreseeable risks.

7. Incident Response

Swift EMS maintains an incident-response plan and will notify affected Organizations in the most expedient time possible and without unreasonable delay after confirming any breach of security that results in unauthorized access to personal information processed through the App. Any consumer notices that an Organization or Swift EMS issues will include the elements required by Wyoming Statutes §§ 40-12-501 et seq. and other applicable state laws.

8. Data Retention

Employee viewing history remains until the Organization deletes it or ends its subscription. Server logs generated by Swift EMS are retained. Guest credentials persist only on the user’s device; deleting the Organization within the App removes the credential and ends access. If a guest later needs access, they must obtain a new registration code.

9. Your Rights and Choices

Because Swift EMS is a service provider, requests to access, correct, delete, or export employee viewing data must be sent to your Organization’s administrator. We will assist the Organization in fulfilling any valid consumer request under CPRA or similar U.S. laws. Guests generate no viewing logs, so there is no associated data to request. If you believe an Organization has granted the App to a child under 13, please notify us at the email below and we will work with the Organization to remove any associated identifiers.

10. “Do Not Track” and Global Privacy Controls

The App does not track users across third-party sites or services, so it does not respond to “Do Not Track” signals or global privacy-control headers.

11. Marketing Communications

The App currently sends no promotional push or email messages. If Swift EMS introduces optional notifications in the future, users will be able to opt out in the App settings or by contacting us.

12. International Transfers

All App-related data is stored and processed exclusively in the United States. Swift EMS does not transfer this data across national borders.

13. No Warranty / Limitation of Liability

Nothing in this Policy limits any disclaimers or liability caps set out in the Master Subscription Agreement or other contract between Swift EMS and the Organization. This Policy is provided “as is” and does not create any warranty beyond those expressly stated in such agreements.

14. Governing Law

This Policy is governed by the laws of the State of Wyoming, without regard to conflict-of-law principles.

15. Changes to This Policy

We may update this Policy to reflect operational or legal changes. The “Last updated” date shows when we most recently revised it. Continued use of the App after an update signifies acceptance of the revised Policy.
